Well, the news source Andy quoted is not know for its accuracy.

So I looked at the changes made to the gmail terms and found this http://gmail.google.com/gmail/help/program_policies_redline.html

Seems like they had "Sell, trade, resell or otherwise exploit for any unauthorized commercial purpose or transfer any Gmail account" in the terms all along.
