One of my client site service page content is been copied by a competitor including the client company name :) to his service page(sound funny right?) is ranked 4 and my client site service page rank's 3, why this happens? :D

Welcome to SEW jag but, it's hard to say for sure without seeing examples. Is the company name trademarked? You might suggest your client take a legal approach to this matter.

Yes, we are in that process, but how come its been ranked more than original website?

Like Beu said, there's tons of ways something like this could be happening, and not a lot of info to go on... BUT it sounds suspiciously like they're bombing you in some way... especially if you guys have the same content and they're doing a better job of making sure that Google finds them first. I'd be sure your pages are crawl-able, and you're doing everything to be sure Google can get to your content pages - SEO basics, but crucial ... And have you tried to submit the issue to Google?
Thanks for the replies, i have asked the company to remove the content and they did, but its bad that duplicate content pages gets popularity more than original one's.
The search engine system should have an index date (may be SE can have cache date) with ref to site / content which can be used for non-ranking or non-indexing duplicate pages, what do you all say?
