Maybe this is not right forum, but here it goes.


I see various number of sites are distributing files through megaupload, rapidshare etc.

Lots of these files are distributed illegally. Like movies, applications, games etc...


However it seems (since these sites have been around for a long time) that is legal to post news about movie and bellow download link to megaupload...

Is this illegal? Can these sites post download link to megaupload to download latest movies or music.

For example:

"New Red Hot Chilly Peppers album is out the song list is bla bla bla and you can download it from megaupload.com"

I know this is wrong but is it illegal?

Unless megaupload has the express permission of the artist/label/etc., then yes, it is totally illegal.

Hmm...

But what if links are submitted by other users not site owners?

What if there is text saying that "site is not taking any responsibility on user posts".

Sorry, I should've said "unless the user OR Megaupload. has permission."

Basically:
If users are posting copyrighted material, users are breaking the law.
If users are advertising that they have posted copyrighted material, users are breaking the law.
If Megaupload advertises that users have posted copyrighted material, Megaupload is breaking the law.
If Megaupload is expressly aware of individual content violations and expressly permits them to continue, Megaupload is breaking the law. But this is tricky, because it's easy for Megaupload to not be "expressly" aware of individual violations.

Once a site such as Megaupload or Rapidshare is notified that users have posted copyrighted material without permission, the site will typically remove the content. (Once a site is made aware of illegal content, I believe they're required by law to remove it.)

There is no way in the Gods green earth that megaupload can track all the files uploaded.

The problem is not violation. I just can't understand how some sites for over 3 years producing "news" about where to get illegal software/movies/music and still are up. They are .com domains. Is there violation on domains. I understand laws are up to individual countries but how is the question with the ownership of the domain?
