I've never see the TM tradmark symbol attached to anything related to ODP. Copyright notices, yes, but TM, no. I know that doesn't answer your question, but that's all the info I have.

I can't imagine they didn't try, I think it started life as a commercial venture, or as least the founders "sold out". Maybe the words are just too generic?
